Is Drone Deer Recovery Legal in North Dakota? (2026 Rules)

Not clearly. North Dakota bans using any aircraft, manned or unmanned, to kill, chase, harass, or disturb game. The rule doesn’t specifically mention recovering a wounded or dead deer. Here’s what it says.

What North Dakota’s rule says

From North Dakota Game and Fish’s 2026-27 hunting guide:

“It is illegal to kill, chase, harass, flush, drive, concentrate, rally, raise, stir up or disturb game with all types of aircraft, manned or unmanned.”

The rule doesn’t mention recovery or make an exception for it. North Dakota’s deer season proclamations may have additional aircraft rules, so check the current deer proclamation too.

Tip: since flying in a way that disturbs or drives game isn’t allowed, any search should never push or move a deer.

Which animals does this cover?

North Dakota’s rule covers all game. In North Dakota, that includes white-tailed and mule deer, pronghorn (antelope), elk, moose, and bighorn sheep.

How North Dakota defines hunting

North Dakota law defines “hunt” or “hunting” as including:

“shooting, shooting at, pursuing, taking, attempting to take, or killing any game animals and game birds; searching for or attempting to locate or flush any game animals and game birds …”

So in North Dakota, searching for or attempting to locate game is part of the legal definition of hunting.

Finding a pilot

Drone Deer Tracker is adding pilots in the Plains. Check the map for the closest pilot to your hunt. Are you a thermal drone pilot in North Dakota? Apply to be listed.

Verify before you fly

Drone rules change, and how they apply can depend on your situation. Before any drone recovery, contact North Dakota Game and Fish to confirm it’s allowed.
